These Terms of Use (“Terms”) govern your use of peakmolding.com (the “Site”), operated by Peak Molding (“Peak Molding,” “Peak,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Our Privacy Policy is part of how we operate the Site. These Terms control if there is a conflict about use of the Site.
Who we are and what this Site is
Peak Molding is a Utah-based United States sourcing and program-management partner for plastic injection molding and tooling. We do not run a shop. We place work with US shops. Peak quotes, tracks, and stays on the program. Shops do the steel and the shots. The Site identifies us as Peak Molding, US-headquartered in Utah, USA. You can reach us at:

The Site is for information and quote requests. Content on the Site, including the cost calculator, is general information, not a promise of a specific part, shop, price, or window.
Shop intake is a request to be considered for Peak’s shop network. It is not an employment application and not an offer of work.
Quotes are not a contract
Sending a quote request, uploading files, or receiving a reply is not an offer to sell and not a manufacturing contract. A quote is an estimate, not a purchase order (PO). Tooling and piece-price come back after a US shop quotes. Peak does not publish a guaranteed clock. The cost calculator is an indicative range, not a Peak quote.
Manufacturing and program terms live in a separate writing. Until that writing, neither side is obligated. Send a quote request at Get a quote.
User-submitted files
When you upload files or drawings, you represent that you have the right to share them; that sharing them does not violate a confidentiality obligation unless you are authorized to share them with us; and that they do not infringe intellectual property you are not allowed to share.
Peak uses files to quote, including sharing them with US shops. We treat them as confidential as described in the Privacy Policy. Sending files is not an NDA. If you need a signed NDA before you upload, email [email protected] first.
No unlawful uploads
Do not upload or submit anything unlawful, malware, or spam. Do not bypass the bot check. Do not scrape the Site in a way that harms it. We may refuse abusive submissions.
Intellectual property of the Site
Peak Molding and its licensors own the Site’s text, layout, graphics, and logos. You may view and print pages for internal evaluation. You may not copy the Site to compete with Peak, scrape it for a competing product, or use our name or marks to imply an endorsement without written permission.
Files you submit remain yours. You grant Peak a limited license to use, store, copy, and share those files solely to evaluate them, quote them, communicate with you, keep records, and — if you later place work — to source and manage that work under a separate agreement.
Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK MOLDING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. NOTHING ON THE SITE IS PROFESSIONAL ENGINEERING ADVICE, DFM SIGN-OFF, OR A WARRANTY OF MOLDED PARTS.
Limitation of liability
This section is about the website, not a product warranty for molded parts.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK MOLDING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PEAK MOLDING’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100).
Some states do not allow certain limitations of liability. In those states, our liability is limited to the fullest extent the law allows. Nothing in these Terms limits liability that the law does not permit us to limit, including liability for fraud or willful misconduct.
Indemnity for user-submitted content
You will defend, indemnify, and hold harmless Peak Molding from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of files or other content you submit, including claims that you lacked the right to share them, that they infringe intellectual property or a trade secret, or that you used the Site unlawfully.
Governing law and venue
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. The state and federal courts in the State of Utah have exclusive jurisdiction over disputes arising out of the Site or these Terms. If you later sign a purchase order or other program writing, that writing controls for that job.
Changes
We may change these Terms by posting a new version on this page and changing the effective date. Your continued use of the Site after we post changes means you accept the new Terms.
